snow is tapering off, still snowing over much of the area, but highway 80 is winding down. chains are still required going into, and out of the tahoe area, our 24 hour totals vary from a quarter inch in places like san jose to over an inch in clover dale. snowfall totals in the sierra 18 inches in squaw valley only six inches in south lake tahoe. there is an avalanche advisory. and more showers coming our way. we'll take a look in just a moment. >> thank you. >> and the weather is much more intense in the mid west. violent storm system spawns tornadoes killing nine people in ill skpil missouri. there will be a live report from one of the hardest-hit areas in 10 minute ootz wife of ross mirkarimi suffered a legal defeat today in efforts to get key evidence against her husband thrown out of the domestic violence case.

the judge rejected a motion to throw out pictures showing bruises on the arms of lopez, as well as a videotaped statement she gave to a neighbor. lopez's attorney claims the statement and grotz were protected under attorney-client privilege because lopez thought the neighbor was an attorney. >> the entire fabric of this judicial system is dependent on attorneys holding up our responsibilities including keeping a client's confidence to ourselves. >> the judge rejected lopez's motion that the case be thrown out. the judge ruled lopez does not have legal standing. mirkarimi has pleaded not guilty to three misdemeanor counts. >> and one time hell's angels member captured saturday after a four-month long search made a court appearance today. and he's accused of shooting

another hell's angel member at a fub funeral. >> steven ruiz appeared calm in court this afternoon, he's facing homicide charges stemming from an argument in october. the motive is still unknown. >> the 39-year-old steven ruiz was brought into the courtroom under heavy security. but there is no evidence of hell's angels inside or outside of the courtroom. ruiz is be being charged with a count of homicide in the death of another hell's angel member at oakhill cemetery, both there for the funeral of the san jose's hell's angels chapters president. defense attorney told reporters after arraignment he will be filing a request for a gag order. >> we don't want to spoil the jury pool by negative publicity. that is all.

the only way he's going get a fair trial is with juror who's have not made their minds up before coming to work. >> ruiz arrested saturday in a motel after eluding police for three months. we asked his attorney if still associated with the hell's angel autos when something this drastic happens he's shunned as religion shuns people. he is then excommunicated to use the catholic term, disassociated to use a term used in various organization autos ruiz told his attorney ze not need special protection inside jail. he's expected to enter a plea when returning to court in two weeks. he's being held without bail. >> with heightened security there was a tense moment at the hall of justice this afternoon ai. jail house visitor droppings something out of his pocket, it was a

popper a small firecracker. you can imagine, deputies were all over him. >> and some people what you wouldn't to change the way san francisco gets water kicks off their campaign today. under the plan the city could stop using the hetch hetchy reservoir. the group advocates the use of local water resources. >> you know right now no one is saying that it drained or the dam torned down. not yet. the organization to restore hetch hetchy is filing paper work today. what proponents want is for officials to come up with ways to maximize the supply without using the hetch hetchy reservoir, in other words it could be more sustainable if the city did things like recycle water, and the city does not collect rainfall.

there are things they say we can do that would allow us to not depend on hetch hetchy. currently san francisco gets its water from the river, it's one of nine reservoir that's store the water. and they say then, the city would goin think about returning valleys to how it was before. >> but we filed today with the ballot initiative that doesn't require hetch hetchy be restored but requires for san francisco to develop a plan to reform it's 19th century water system and figure out ways to adopt more sustainable practice autos supporters will need to gather nearly a thousand signatures in order to put initiatives on the november ballot. one of the main opponents of the plan is san francisco mayor ed lee. >> this ais a wasteful idea is that that doesn't reflect, i think the care that we've had

some of the worst damage is in harrisburg, six people have been killed. reporter ben bradley is in harrisburg now. what is the situation? >> we're standing in just one of nearly 300 homes damaged or destroyed in a small southern illinois community that only has 9,000 residents. most of them were asleep at 5:00 this morning when sirens sounded. 13 hours after the storms struck, sharon murray can't believe her eyes. >> it's gone. you know? it's like your life is wiped out. and, but, i've had a lot of family and friends and we've been digging through and did find picture and my dad's bibles. that is what is important. >> they weren't home at 5:00 this morning she was at work at the local hospital. next door, bob and his wife micky sought shelter in their bedroom. the only part of the home the storm spared. >> i took about five steps

into my hallway and looked up. and there went the roof of my house, just, gone. i was looking up at the sky. you know? >> the national weather service began warning the possibility of a tornado touchdown 27 minutes before it roared into harrisberg. that apartment building was the first stop before 170 miles per hour winds worked their way northeast, killing six and damaging nearly 300 homes and businesses. now, nel found her severely injured neighbor had been blown into her backyard. >> i kept her until they got an ambulance. >> help is already on the way. governor quinn declared a state of emergency, opening the door for federal disaster assistance. >> what is inspiring is how many people are banding across illinois, rising to the occasion helping their neighbors. >> we'll rebuild this city. we will make this city stronger.

in this sierra, we'll see about six to 12 inches of new snow, two to four feet of snow above 6,000 feet and hazardous conditions and travel delays are likely with this weather. satellite radar shows we're in between systems now and the weather swept through during early morning hours, second one coming our way. there is just a few likely tonight. we'll start at 7:00 and during evening and overnight hours, there will be some widely scattered showers and snow levels down to 4,000 feet. and there are more showers tomorrow, then, over by 5:00 in the afternoon. and sooner. and we'll get clearing late in the day and rainfall totals from tomorrow's event won't

and seems like we're headed for $5 a gallon and gas prices in california expected to hit a new record. >> this is happening just as california refineries ship tens of thousands of barrels out of state. laura anthony is live this afternoon in a gas station in walnut creek. laura? >> and this is prices shooting up here at the pump. a fair amount of the gasoline

refined here in the bay area being exported to places like mexico and oregon but experts tell thaws that is a direct result of consumers here successfully cutting back on consumption. why californians pay record prices at the pump refineries are shipping tens of thousands of barrels out of the state. and out of the country every day. >> do you that i can stay here? >> yes. should stay here. >> according to the energy commission last year, the refineries produced over a million barrels of gasoline per day. 10% was exported to other states and countries. that as prices here continue to skyrocket. >> the main driver of the price of gas lien in california and everywhere is the price of oil. >> co-director of the school
